This privacy policy explains how SoundsGood Presents LLC ("SoundsGood", "we", "us") collects, uses and discloses personal information, and the rights you have over it. It applies to soundsgoodpresents.com and our online store. For any privacy request, contact info@soundsgoodpresents.com.

Categories of personal information we collect

In the last twelve months we have collected the following categories of personal information:

  • Identifiers - name, postal address, email address, and an online identifier or IP address.
  • Customer records - billing and delivery address, telephone number where supplied, and payment information processed by our payment providers. We do not receive or retain full payment card numbers.
  • Commercial information - products purchased or considered, order history, and returns.
  • Internet and network activity - pages viewed, referring pages, approximate location inferred from IP address, and device and browser type.
  • Inferences - limited preferences drawn from purchase history, used to decide what to feature.

We do not collect sensitive personal information as that term is defined under California law, and we do not use or disclose any such information for purposes requiring a right to limit.

Where the information comes from

  • Directly from you, when you order, contact us, or subscribe to our newsletter.
  • Automatically from your device, when you use the site.
  • From our service providers, including our store platform, payment providers and carrier.

Why we use it

  • To take payment for, fulfil and deliver your order, and to administer returns.
  • To communicate with you about your order.
  • To respond to enquiries you send us.
  • To send our newsletter where you have asked to receive it. Every newsletter includes an unsubscribe link.
  • To maintain the security, integrity and availability of the site and to prevent fraud.
  • To comply with our tax, accounting and other legal obligations.

We do not sell or share your personal information

We do not sell personal information, and we do not share it for cross-context behavioural advertising, as those terms are defined under California law. We have not done so in the preceding twelve months. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Who we disclose it to

We disclose personal information for business purposes to service providers who process it on our behalf, under contract, and only on our instructions:

  • Shopify - our store and checkout platform, which processes orders, customer records and payments.
  • Our payment providers - to authorise and settle payment.
  • Our email provider - to send transactional order emails and the newsletter.
  • Our delivery carrier - to deliver your order, which requires your name and delivery address.
  • Our professional advisers - accountants and lawyers, where necessary.

We may also disclose personal information where required by law, court order or lawful request by a public authority, or in connection with a sale or reorganisation of our business, in which case we will require the recipient to honour this policy.

How long we keep it

Order and transaction records are retained for the period required by tax and accounting law, currently seven years from the end of the relevant tax year. Newsletter subscription data is retained until you unsubscribe. Enquiry correspondence is retained for two years. Site analytics data is retained for 26 months. We delete or de-identify personal information once it is no longer needed for a disclosed purpose.

Your rights

Depending on where you live, and in particular if you are a California resident, you have the right to:

  • Know and access - request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of recipients.
  • Delete - request deletion of personal information we hold about you, subject to exceptions where we are required to retain it.
  • Correct - request correction of inaccurate personal information.
  • Opt out of sale or sharing - we do not sell or share personal information, so there is nothing to opt out of. If that ever changes, we will provide a clear opt-out mechanism before it does.
  • Non-discrimination - we will not deny you goods or services, charge a different price, or provide a different quality of service because you exercised any of these rights.

To make a request, email info@soundsgoodpresents.com with the request and enough information for us to locate your records. We verify requests by matching the information you provide against our records, and may ask for confirmation from the email address associated with your order. We respond within 45 days, and may extend once by a further 45 days where reasonably necessary, telling you if we do.

An authorised agent may make a request on your behalf. We will require written proof of authorisation and may ask you to confirm it directly.

California Shine the Light

California Civil Code section 1798.83 permits California residents to request information about disclosure of personal information to third parties for their direct marketing purposes. We do not make such disclosures. To ask, email info@soundsgoodpresents.com.

Cookies and Do Not Track

We use cookies that are strictly necessary for the site and store to function, including keeping you signed in and remembering the contents of your basket, and a limited number that help us understand how the site is used. You can block or delete cookies through your browser, though parts of the store may then not work.

There is no common industry standard for responding to Do Not Track browser signals. We do not currently respond to them. We do honour opt-out preference signals to the extent required by California law; because we do not sell or share personal information, such a signal has no effect on our processing.

Security

We maintain reasonable administrative, technical and physical safeguards appropriate to the nature of the information we hold. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Children

The site and store are not directed at children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, contact info@soundsgoodpresents.com and we will delete it.

Governing law

This policy is governed by the laws of the State of California, without regard to its conflict of laws rules. Nothing in it limits any right you have under applicable law that cannot be limited or waived.

Changes to this policy

We may update this policy. The date shown at the top of this page indicates when it was last changed. Where a change is material we will take reasonable steps to notify you.
